Terms and Conditions
1. WHO WE ARE
The IKI LAND venue at Strada Speranței nr. 21-23, Bragadiru, Ilfov County, and the iki-land.ro website are operated by TABOO MASTER S.R.L., with its registered office at the same address, registered with the Trade Register under no. J2014001910237, tax identification number (CUI) RO33335193 (“IKI LAND”, “we”).
Contact: 0720 075 598, 0737 318 935, contact.ikiland@gmail.com.
In this document, “client” means any natural or legal person who contracts IKI LAND services, and “consumer” means a client who is a natural person acting outside their trade or profession. Some of the rights below belong only to consumers. Businesses that book events are dealt with in section 6.
2. WHAT WE OFFER
- restaurant, garden, terrace and café;
- children's playground, with access by ticket;
- children's parties, with the packages presented on the website and in the written offer available at reception;
- private events (birthdays, christenings, corporate events) and catering for them.
The iki-land.ro website is for presentation purposes. No bookings, orders or payments are made through the website.
3. PRICES
Prices are in lei and include VAT and all applicable mandatory charges. The current rates for access and consumption are displayed before each purchase. For parties and events, the offer relating to the Event Form states the total price and the exact method of calculation, namely the package chosen, the minimum number of participants, the separate rates for children and adults and all mandatory costs. The accepted unit prices are not changed unilaterally for a confirmed booking. The final amount results from the accepted conditions, the confirmed number of participants and the additional services expressly accepted by the client.
Staff services (waiters, bartenders, cooks, cleaning staff) at private events are invoiced separately, as set out in the offer. Before booking, the offer shows the amount or the calculation formula and whether these services are mandatory or optional. Optional services are paid for only if they have been expressly accepted. Tips are not included in the price and are at your discretion.
4. THE PLAYGROUND TICKET
The ticket entitles you to use the toys and equipment of the playground for the period paid for, during the displayed opening hours and in compliance with the restrictions of each piece of equipment. A full-day ticket is valid only on the day for which it was purchased and cannot be split over several days. We will tell you the conditions for leaving and re-entering before payment. The playground does not provide nursery, kindergarten or babysitting services. Each child is accompanied by a parent, by their legal representative or by an adult designated by them, who ensures effective supervision in accordance with the Playground and Party Rules. This obligation does not remove IKI LAND's legal obligations regarding the safety of the premises and equipment, maintenance, warnings and intervention in dangerous situations.
Access to and use of the playground are governed by the Playground and Party Rules, made available to the client before the ticket is purchased or the booking is made, displayed at the venue and published on the website.
5. PARTY AND EVENT BOOKINGS
Bookings can be requested at reception, by phone or on WhatsApp. The following booking rules apply to parties:
- the booking becomes firm once all three conditions have been met: the client's acceptance of the offer and the conditions, payment of the confirmatory deposit (arvună) in the amount set in the Event Form (minimum 500 lei), and written confirmation of the booking by IKI LAND. The confirmation states the date, the time slot, the package and the amount received;
- if you cancel the party for a reason not attributable to IKI LAND and not due to force majeure, IKI LAND may terminate the contract, in accordance with the law, and may retain the deposit. The deposit is not retained if the party does not take place because of IKI LAND or because of force majeure;
- upon a request sent in writing (including on WhatsApp or by email) at least 10 days before the party, the party may be rescheduled once only, to a date within 6 months of the date originally set for the party, without losing the deposit, subject to availability and by written confirmation.
- If IKI LAND fails to perform its obligations for reasons attributable to it, the client may terminate the contract and claim double the deposit. Any other amounts paid for services not provided are refunded in full. If the contract ends for reasons for which neither party is liable, the deposit and any other amounts relating to services not provided are refunded. Refunds are made without undue delay, no later than 14 days after the contract ends. Instead of a refund, the party may be rescheduled: at the client's choice, if the non-performance is attributable to IKI LAND, or with the client's agreement, if the termination is not due to either party.
- the final number of children and adults is confirmed in writing at least 48 hours in advance, as set out in the Event Form.
The full text can be found in the Party Booking Rules, in the Playground and Party Rules (section 8) and in the Event Form, published on the website and available at reception.
When we may refuse a booking request. Before the contract is concluded, we may refuse the request if the requested time slot is no longer available or if the requested service cannot be provided lawfully and safely, including where the number of guests exceeds the permitted capacity. In the event of non-performance attributable to IKI LAND after the booking has been confirmed, the rules above apply, including the return of double the deposit or, at the client's request, rescheduling.
Right of withdrawal. Parties and events booked for a fixed date are leisure and catering services with a set date of performance, for which the law does not provide a 14-day right of withdrawal (Art. 16(l) of Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with traders). Cancellation and rescheduling of the event are carried out in accordance with the contractual rules and the applicable legal provisions.
6. EVENTS BOOKED BY BUSINESSES
For events booked by a business, for example corporate events, the conditions are set out in the written offer and in the Event Form. The deposit rules above also apply to businesses, unless the offer provides otherwise. Businesses do not benefit from the rights that the law grants to consumers.
7. PAYMENT
Payment is made at the venue, in cash or by card, and for events also by bank transfer. Fiscal documents are issued in accordance with the law and the payment methods used. An invoice is issued where this is mandatory or, in other cases, on request. For card payments, the fiscal receipt may be printed and handed over at the client's request, in accordance with Art. 1(2^1) of Government Emergency Ordinance no. 28/1999, as introduced by Law no. 317/2024. The absence of a printed fiscal receipt does not affect the consumer rights provided for by Government Ordinance no. 21/1992 on consumer protection, republished, as subsequently amended and supplemented, as the bank statement takes the place of the fiscal receipt as proof of purchase.
8. FOOD BROUGHT FROM OUTSIDE
Food or drink brought from outside may not be consumed at the venue, except for the party cake and food for infants or for medical needs, agreed in advance with the staff. The cake must come from a supplier authorised in accordance with the law and be accompanied by documents on its origin, ingredients and allergens, storage and shelf life. The requirements are communicated before booking. IKI LAND may refuse, giving the reason, a product whose safety cannot be ensured. For the dishes provided by IKI LAND, the mandatory information, including allergen information, is available before ordering. Allergies and dietary restrictions are entered in the Event Form, without the names of the guests; for a specific child, that child's parent completes the Annex “Allergies and Dietary Restrictions”.
9. LIABILITY
IKI LAND is liable in accordance with the law for the services provided, the acts of its staff and the damage for which the law makes the operator liable, including damage caused by things in its custody. Obligations regarding safety, maintenance, hygiene, warnings and the organisation of activities are not transferred to children or accompanying adults.
- If damage is also caused by failure to follow the instructions given, liability is determined in accordance with the law, according to each person's contribution.
- For damage caused by other clients, each person's liability is determined in accordance with the law.
- Clients must keep their personal belongings safe. Not handing them over for safekeeping does not exclude IKI LAND's legal liability, where the conditions for such liability are met.
- Nothing in this document limits or excludes IKI LAND's liability where the law prohibits this, in particular for harm to life, physical integrity or health and for damage caused intentionally or through gross negligence (Art. 1355 of the Romanian Civil Code). The rights that the law grants to consumers remain unaffected.
- The client is liable, under the conditions of the law, for damage caused to the equipment and property on the premises by their own acts or by the acts of the children they are obliged to supervise.
10. ACCESS TO THE VENUE
For everyone's safety, we may refuse entry to anyone who meets any of the following, or ask them to leave the venue:
- breaches the Playground and Party Rules after having been warned;
- behaves aggressively or violently towards other people;
- is under the influence of alcohol or other substances, in a state that endangers the safety of others;
- shows objective signs of a contagious disease, on entering the playground.
We do not refuse access on grounds of origin, ethnicity, religion, sex, disability or any other grounds prohibited by law.
11. VIDEO SURVEILLANCE AND PHOTOGRAPHS
The venue is under video surveillance. Photographing and filming by the IKI LAND team for promotional purposes, and the use of identifiable images of children, take place only after the entitled legal representative has been informed and has given separate, specific, free and documented consent, with due regard to the best interests of the child. Details are in the Privacy Policy and in the CCTV Notice.
12. COPYRIGHT ON THE WEBSITE
The texts, photographs, logo and materials on iki-land.ro belong to TABOO MASTER S.R.L. or are used with the authors' permission. They may not be copied or used for commercial purposes without our written consent (Law no. 8/1996 on copyright and related rights, republished).
13. COMPLAINTS
Concerns and complaints may be sent by email to contact.ikiland@gmail.com, in writing to our place of business, by phone or directly at reception. To help us identify the situation and resolve it, please state your name and contact details, the date of the visit or event, a description of the circumstances reported and the solution you are asking for. IKI LAND will examine the complaint and reply without undue delay, within a reasonable period, depending on the nature and complexity of the situation. Submitting a complaint to IKI LAND is not a precondition for, and does not restrict, the right to refer the matter directly to the competent authorities.
14. DISPUTE RESOLUTION
IKI LAND encourages the amicable resolution of any disagreements and makes every effort to find a fair solution through dialogue with consumers. Without this step being a precondition, consumers may contact:
- the National Authority for Consumer Protection (ANPC), through its official channels, www.anpc.ro;
- alternative dispute resolution (ADR) entities, through the official ANPC platform, reclamatiisal.anpc.ro.
Disputes that are not resolved amicably are settled by the competent courts in accordance with the law, without restricting the consumer's right to bring proceedings before the court of their place of residence. Romanian law applies, including Government Ordinance no. 21/1992 on consumer protection, republished, and Law no. 193/2000 on unfair terms in contracts concluded between traders and consumers, republished.
15. CHANGES TO THESE TERMS
IKI LAND may amend these Terms and Conditions, and the updated version will be published on the website, stating the date on which it comes into force. For parties and events already booked, the version in force on the date the Event Form was signed continues to apply.
